By submitting your entry into the contest, you hereby represent that (i) you are in good health and in proper physical condition to participate in the contest and (ii) it is your sole responsibility to determine whether you are sufficiently fit and healthy enough to participate in the Paige's Fitin5 Weeks Challenge or use the training/nutrition plans offered as part of the contest. You understand and acknowledge the physical and mental rigors associated with exercise and using the plans provided as part of the contest involves risks and dangers which include, without limitation, the potential for serious bodily injury, death or other damage. You hereby expressly assume all such risks and responsibility for damages, liabilities, losses or expenses which you incur as a result of participation. Any recommendation for changes in diet including the use of food supplements, weight reduction and/or body building enhancement products are entirely your responsibility and you should consult a physician prior to undergoing any dietary or food supplement changes. You further understand that refunds will not be given for the contest. Once you submit payment you will be one of the contestants for that month's challenge even if, for whatever reason, you are unable to complete the challenge. There is a $49 digital download fee taken off the top of every refund. You are only eligible for a refund if you cancel before you receive your diet and training program. If you do cancel before receiving plans, your refund will then show the $49 digital download fee deducted. You further agree that there will be a $25 fee to move to a different starting group for any reason after signing up. There is a $49 fee to move to a different challenge. Any changes in challenge dates needs to approved by Paige, and will be subject to a $49 Challenge Change Fee. You further agree that signing up for the payment plan is NOT a subscription which can be cancelled. By choosing the payment plan option you are agreeing to commit to paying the four weekly payments. If for any reason your payment is not able to be processed on your scheduled payment date, you will have three days to submit payment or agree upon another payment date with Paige and the Fitin5 team before being removed for the current challenge. If this occurs, you will be eligible to restart your challenge later once payment has been received in full in addition the the $49 Challenge Change Fee.
By submitting your entry you further agree and acknowledge that there is a total winnings of $5,000 split between the three winners of each full challenge consisting of three groups. By submitting your payment for this challenge you further acknowledge that you have carefully read this waiver and release and fully understand that it is a release of liability. By submitting your entry to the challenge, you expressly agree to release and discharge the trainer or instructor from any and all claims or causes of action and you agree to voluntarily give up or waive any right that you may otherwise have to bring a legal action against the trainer or instructor for personal injury or property damage. To the extent that statute or case law does not prohibit releases for negligence, this release is also for negligence. If any portion of this release from liability shall be deemed by a Court of competent jurisdiction to be invalid, then the remainder of this release from liability shall remain in full force and effect and the offending provision or provisions severed here from. By submitting your entry, you are acknowledging that you understand its content and that this release cannot be modified orally. Paige Hathaway LLC does comply with and abide by federal tax laws, in accordance to this compliance, all winners will be required to complete a W-9 form before collecting their prize money. All winners for the challenge are chosen at the sole discretion of Paige Hathaway and the Fitin5 team. Any photos, information, and or other items submitted as part of the contest shall become the property of Paige Hathaway LLC and by submission of the same, you are hereby granting Paige's Fitin5 Weeks Challenge, and its affiliates, owners and assigns, permission to utilize your name, information, images and likeness to use the same throughout the world and in all manners both now and in the future. You are further releasing the Fitin5 and, Paige Hathaway LLC, their employees, agents, affiliates and assigns from any and all claim that may result from of the use of the above, including defamation, invasion of privacy, infringement, or copyright. All international applicants will be responsible for any and all shipping costs that apply.
